This agreement has been created to protect the personal information of customers registered in the system of ARC Hosting Telecommunications (ServerPlus Internet Services) as required by legal legislation.

 

Under the Personal Data Protection Law No. 6698 (“KVKK”) and other relevant legislation, as ServerPlus Internet Services ("ARC Hosting"), acting as the Data Controller, we would like to inform our valued users that your personal information will be recorded, stored, updated, and, where permitted by law, disclosed/transferred to third parties, classified, and processed in accordance with other procedures and principles specified in the relevant legislation. Use in products and services offered under the Electronic Communications Law No. 5809 and other relevant legislation,

Fulfillment of storage, information, reporting, and other related obligations arising from the relevant legislation,

Meeting the information and document requests of the Information Technologies and Communication Authority and other relevant authorized/competent authorities,

Providing other Products/Services of our company,

Fulfillment of the obligations of the service contract concluded,

Due to the performance of the service contract, ARC Hosting and ARC Hosting Parties obtaining personal data as a Data Controller (as defined under European Laws and Regulations or corresponding under local laws related to data protection or privacy), ARC Hosting and ARC Hosting Parties processing personal data; (i) in relation to the provision of the Licensed Area and Services; (ii) account management, billing and reconciliation; operational maintenance and support activities; security, fraud detection and prevention and customer and market analysis and reporting, provided that the personal data has previously been made public; and (iii) communication with the Customer via voice, letter, fax, or email regarding the products and services of ARC Hosting or ARC Hosting Parties or third parties through the ARC Hosting Marketplace.

ARC Hosting may share your personal data with the following individuals or organizations within the framework of the relevant legislation:

Authorized and competent individuals and legal entities under the Electronic Communications Law No. 5809, the Law No. 5651 on Regulation of Broadcasts Made on the Internet and the Combating of Crimes Committed through These Broadcasts, and other relevant legislation, - Group companies, ARC Hosting parties, companies we cooperate with, program partners, and other third parties for the performance and control of services under your service contract.

 

Methods of collecting personal data;

 

Your personal data can be collected verbally, in writing, or electronically through channels such as the website, Online Transaction Center, Call Center, our company's mobile applications, social media platforms, service contracts, and solution partners. Under the Personal Data Protection Law No. 6698, you have the right to; by making a written application to ARC Hosting Telecommunications:
b) request information if processed,
c) learn the purpose of processing and whether it is used in accordance with its purpose,
d) know the third parties to whom it is transferred domestically/abroad,
e) request correction if processed incompletely/incorrectly,
f) request deletion/destruction within the framework of the conditions stipulated in Article 7 of KVKK,
g) request notification of the actions taken under (d) and (e) to the third parties to whom it has been transferred,
h) object to outcomes due to analysis made solely with automated systems,
i) request compensation for damages in case of damage due to unlawful processing.
